All services are subject to availability and acceptance of quotation by D Hall Plant Hire & Groundworks Ltd.

3. Quotations & Pricing

3.1 Quotations

All quotations are provided free of charge and are valid for 30 days unless otherwise stated. Quotations are estimates based on the information provided and may be subject to change if site conditions differ from those described or anticipated.

3.2 Pricing

All prices are quoted in GBP (£) and are exclusive of VAT unless otherwise stated. Prices include:

  • Labour and materials (as specified in quotation)
  • CPCS-qualified operators (for operated plant hire)
  • Delivery and collection within agreed service area

3.3 Price Changes

We reserve the right to adjust prices due to unforeseen circumstances including (but not limited to) changes in site conditions, additional work requested, increased material costs, or delays beyond our control. Any price changes will be communicated and agreed upon before proceeding.

3.4 Additional Charges

Additional charges may apply for services outside the original scope of work, emergency call-outs, weekend/bank holiday work, travel outside standard service area, or damage to hired equipment.

4. Booking & Acceptance

4.1 Booking Process

To book our services, you must accept our written quotation. Acceptance can be communicated via email, phone, or signed quotation. A booking is confirmed once we have received your acceptance and any required deposit.

4.2 Deposit Requirements

For certain projects, we may require a deposit (typically 20-50% of the total quoted price) to secure your booking. Deposit amounts will be specified in your quotation. Deposits are non-refundable except as outlined in our cancellation policy (Section 6).

4.3 Site Access

The client is responsible for ensuring safe and reasonable access to the work site. This includes clear access for equipment delivery, adequate working space, and notification of any underground services, overhead cables, or other hazards. Additional charges may apply if access is restricted or unsafe conditions are encountered.

5. Payment Terms

5.1 Payment Methods

We accept payment by bank transfer, cash, or cheque. Payment details will be provided on invoices.

5.2 Payment Schedule

Unless otherwise agreed in writing:

  • Small projects (under £5,000): Payment due in full upon completion
  • Larger projects: Payment in stages as outlined in quotation, with final payment due within 7 days of completion
  • Plant hire: Payment due weekly or monthly as agreed, or upon return of equipment

5.3 Late Payment

Payment is due within the timeframe specified on the invoice. Late payments may incur interest charges at a rate of 8% above the Bank of England base rate per annum, plus a fixed charge of £40 for debt recovery costs, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5.4 Disputed Invoices

If you dispute any invoice, you must notify us in writing within 7 days of the invoice date, specifying the grounds for dispute. Any undisputed portion of the invoice remains payable.

6. Cancellation Policy

6.1 Client Cancellations

More than 7 days before start date:

Full refund of deposit minus 10% administration fee

3-7 days before start date:

50% refund of deposit

Less than 3 days before start date:

No refund of deposit

Work already commenced:

Payment due for all work completed plus materials supplied

6.2 Our Right to Cancel

We reserve the right to cancel or postpone work due to adverse weather conditions, equipment failure, staff illness, or other circumstances beyond our reasonable control. In such cases, we will reschedule at the earliest opportunity and any deposit paid will be refunded in full if rescheduling is not possible.

6.3 Plant Hire Cancellations

For plant hire bookings, cancellations must be made at least 48 hours before the scheduled delivery time for a full refund. Cancellations with less notice will incur a 50% charge of the first day's hire rate.

7. Plant Hire Specific Terms

7.1 Equipment Condition

All plant and equipment is provided in good working order. The hirer must inspect equipment upon delivery and report any defects immediately. The hirer is responsible for the equipment from delivery until collection.

7.2 Use of Equipment

The hirer agrees to:

  • Use equipment only for its intended purpose
  • Ensure only competent and qualified operators use the equipment
  • Comply with all health and safety regulations
  • Not allow equipment to be used by unauthorized persons
  • Not remove equipment from the agreed site location
  • Not sublet or lend equipment to third parties

7.3 Damage & Loss

The hirer is responsible for any damage to, loss of, or theft of hired equipment during the hire period. Fair wear and tear is acceptable. The hirer will be charged the full repair or replacement cost for any damage beyond normal wear and tear.

7.4 Fuel & Consumables

Equipment is delivered with a full tank of fuel. Self-drive hirers must return equipment with a full tank or pay a refueling charge. Operated plant hire includes fuel costs.

8. Liability & Insurance

8.1 Our Insurance

We maintain the following insurance coverage:

  • Public Liability Insurance: £5,000,000 (including coverage up to 5 metres below ground)
  • Employers Liability Insurance: £10,000,000
  • Equipment and plant insurance

8.2 Limitation of Liability

We accept liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation. Subject to this, our liability is limited as follows:

  • Our total liability shall not exceed the total price paid for the services
  • We are not liable for indirect or consequential losses including loss of profits, business, or opportunity
  • We are not liable for delays or failures due to circumstances beyond our reasonable control
  • Claims must be notified in writing within 30 days of completion of works

8.3 Workmanship Warranty

We warrant that all work will be carried out with reasonable care and skill using suitable materials. Any defects in workmanship reported within 12 months of completion will be rectified free of charge, provided the defect is not due to normal wear and tear, misuse, or third-party interference.

8.4 Client Responsibilities

The client is responsible for obtaining all necessary permissions, permits, and approvals before work commences. The client must disclose all known underground services, utilities, and site hazards. We are not liable for damage to undisclosed services or hazards.

9. Intellectual Property

9.1 Website Content

All content on this website, including text, graphics, logos, images, and software, is the property of D Hall Plant Hire & Groundworks Ltd or its content suppliers and is protected by UK and international copyright laws.

9.2 Use of Content

You may view, download, and print pages from this website for personal, non-commercial use only. You may not reproduce, modify, distribute, or commercially exploit any content without our prior written permission.

9.3 Trademarks

"D Hall Plant Hire & Groundworks" and our logo are trademarks of D Hall Plant Hire & Groundworks Ltd. Unauthorized use of these marks is prohibited.

10. Health & Safety

We are committed to maintaining high health and safety standards. We are CHAS (Contractors Health and Safety Assessment Scheme) accredited and comply with all relevant health and safety legislation.

10.1 Site Safety

We will conduct risk assessments and provide method statements for all works. The client must ensure a safe working environment and notify us of any site-specific hazards or safety requirements.

10.2 Incidents

Any accidents, incidents, or near-misses must be reported immediately. We maintain appropriate insurance and follow HSE reporting procedures for all incidents.

11. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including (but not limited to) acts of God, extreme weather conditions, strikes, lockouts, accidents, war, terrorism, fire, breakdown of plant or machinery, or shortage of materials. We will notify you as soon as practicable and make reasonable efforts to minimize the impact of such circumstances.

12. Data Protection

We process personal data in accordance with our Privacy Policy and UK GDPR. By engaging our services, you consent to the processing of your personal data as described in our Privacy Policy.

13. Dispute Resolution

13.1 Complaints Procedure

If you are dissatisfied with our services, please contact us immediately. We will investigate all complaints and endeavor to resolve disputes amicably within 14 days.

13.2 Alternative Dispute Resolution

If a complaint cannot be resolved directly, we are willing to engage in alternative dispute resolution procedures, including mediation or arbitration, before pursuing legal action.

14. Governing Law & Jurisdiction

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes constitutes acceptance of the modified Terms. For ongoing contracts, changes will not affect existing agreements unless mutually agreed.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any written quotation, constitute the entire agreement between you and D Hall Plant Hire & Groundworks Ltd and supersede all prior agreements, representations, or understandings.
